W Message Board and W Book Club Membership Terms & Conditions

1. By becoming a W Message Board or W Book Club member, you agree to be bound by the Terms & Conditions set out below.
2. This website is owned and operated by FOXTEL Management Pty Limited (‘FOXTEL') ABN 65 068 671 938.

Your Membership

1. You acknowledge and agree that you are an Australian resident over the age of 18, or if under the age of 18 you have obtained the necessary permission from your parent or guardian to become a W Message Board and/or W Book Club member.
2. You acknowledge that, depending on your level of membership, you may not have access to certain content on this website.
3. Your membership entitles you to enter a range of competitions made available only to W Message Board and/or W Book Club members, subject to the specific terms and conditions of each competition.
4. Your continuing membership to W Message Board and/or W Book Club is subject to FOXTEL's absolute and sole discretion. FOXTEL may terminate your membership at any time, without notice and for any reason.

W Newsletter

1. Where you have provided your consent, you will receive a W newsletter by email from time to time.
2. You may unsubscribe from the W newsletter at any time by following the unsubscribe instructions contained in the newsletter.

W Message Board

Unlawful Conduct

1. You must not use the W Message Board to threaten, harass, stalk or abuse others. Refrain from all expressions of bigotry, racism, hatred, or excessive profanity. Do not make inflammatory remarks in order to provoke others. Be courteous to others, even if your opinion differs from theirs.
2. FOXTEL does not allow any illegal activities. You must not use the W Message Board to publish, post, distribute or disseminate defamatory, discriminatory, inflammatory, obscene, pornographic or other unlawful material or information. You must not discuss or promote illegal activities, including but not limited to the possession, procurement and consumption of drugs, criminal activity and other associated issues.
3. You must not post any material which you know or suspect (or should reasonably have known or suspected) to be false, misleading or deceptive.
4. You must not use the W Message Board for the purpose of advertising, promoting or soliciting any goods or services, or otherwise engaging in trade or commerce.
5. Administrators and/or Moderators who manage the W Message Board may, in their absolute discretion and without notice, decline to publish posts, delete posts, eject or ban users or terminate or suspend access to the W Message Board where violations of these Terms & Conditions occur.
6. If you think that a post is offensive, unsuitable or has in some other way breached these Terms & Conditions, please email us at w@foxtel.com.au with a link to the post and your reasons for objecting to it. The W Message Board Administrators and/or Moderators will consider whether there are grounds for deleting the post and take appropriate action.

Etiquette

1. You must not post any spoilers of any type on the W Message Board. Do not ruin the suspense for those who don't want to know! Posting of spoilers is considered a severe breach and will result in an immediate ban from the W Message Board.
2. Using all CAPITALS, excessive punctuation, and website URLs in message subjects is forbidden. You may use URLs in the message body.
3. Have a point. Threads with no point will be removed at the discretion of the Administrators and/or Moderators.
4. You must not discuss a topic or post which has been removed from the W Message Board.
5. Use the W Message Board appropriately. Do not use it if your messages would be more appropriate in a private message, email, chat, or phone conversation. Personal matters between yourself and another user must remain between yourself and them.

Privacy and intellectual property

1. You acknowledge and agree that by becoming a W Message Board and/or W Book Club member you are required to provide your name and email address to FOXTEL.
2. When you become a W Message Board and/or W Book Club member FOXTEL may collect certain other personal information about you such as your address and your phone number. You do not have to provide this information to FOXTEL to become a member. It will be your decision whether or not you provide this information to FOXTEL. 3. You are responsible for keeping the information you provide to FOXTEL accurate and up-to-date.
4. The information you provide must be your own information. You must not create a W Message Board or W Book Club membership on behalf of another person.
5. You must not post somebody else's private details on the W Message Board. This includes but is not limited to, the following: real name, workplace, phone number, home address, car registration or e-mail address. Doing so will result in an immediate ban from the W Message Board.
6. You must not upload to the W Message Board files or messages that contain photos, software or other material protected by intellectual property laws (including but not limited to copyright), rights of privacy or publicity or any other applicable law unless you own or control the rights to such material or have received all necessary consents.
7. You acknowledge that FOXTEL may, and you grant FOXTEL (or any person assigned by FOXTEL) a non-exclusive, irrevocable licence to use all intellectual property rights in the material you post on the W Message Board throughout the world, in perpetuity, without restriction and without making payment to you. This licence includes using the material you post on the W Message Board either in its original form, or in an edited form, in various forms of media including in hard copy publications, electronic media and advertising and promotional material.
8. You waive all moral rights in the material you post on the W Message Board, and consent to anything which FOXTEL (or any person permitted to do so by FOXTEL) may do in relation to your content which would otherwise be in breach of your moral rights. This includes that FOXTEL may use your material without attributing you as the source of the material.
9. FOXTEL does not allow posting or use of computer programs that contain destructive features such as: viruses, worms, Trojan horses, or bots for the use of scrolling, showing multiple screens and other activities that can be disruptive to online communication.

Liability and indemnity

1. FOXTEL does not necessarily agree with the views expressed in members’ profiles or on the W Message Board, and accepts no liability in respect of any material contained therein. Any reliance you place on material contained in members' profiles or posted on the W Message Board is done so at your own risk.
2. You are responsible and liable for all your activities while using the W Message Board, including anything you say or post. You are responsible for your W Message Board and/or W Book Club account, including where another person posts material on the W Message Board, using your account.
3. FOXTEL will be under no liability to you in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of your participation in and membership of (or termination of your membership) the W Message Board and/or W Book Club, including your use of the W Message Board or the use by FOXTEL of the material you post on the W Message Board. FOXTEL is not responsible where someone copies your post from the W Message Board and pastes it elsewhere on the internet.
4. These Terms & Conditions must be read in conjunction with the Terms of Use on the W website found at http://www.wchannel.com.au/footer/termsofuse.aspx.
5. These Terms & Conditions are covered by the laws of the State of New South Wales.
6. By agreeing to these Terms & Conditions, you indemnify FOXTEL and its officers, employees and agents against any damage or loss suffered by any of those indemnified, arising, in whole or in part, as a result of your use of the W Message Board, a breach by you of these Terms & Conditions or the use by FOXTEL of the material you post on the W Message Board.
7. These Terms & Conditions are subject to change at the sole discretion of FOXTEL. You should check the Terms & Conditions each time you use the W Message Board, to ensure that you comply.
